This Vybe Privacy Policy (“Privacy Policy”) explains how Vybe Software Inc. (“Vybe”, “we”, “us” or “our”) collects, uses and shares information about you. This Privacy Policy applies to information we collect when you use Vybe’s web application and/or its mobile applications (collectively, the “App”).

Please read this Privacy Policy carefully. When you download, install or use the App, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and consent to Vybe’s collection and use of personally identifiable information (“Personal Information”) and other information as set forth herein.If you do not consent to the terms of this Privacy Policy, you should not access or use the App in any way and should immediately exit the App.

What personal information do we collect from the people that visit our website or app?

Personal Information:

If you desire to access or use the App, you may be required to create an account and submit certain Personal Information and other information to Vybe including your name, email address, and password. We may also obtain information, including Personal Information, from third parties and combine that with information we collect through the App. For example, we may have access to certain information from a third-party social media or authentication service if you log into the App through such a service or otherwise provide us with access to information from such a service. Under no circumstances should you provide your social security number, driver’s license number, or other sensitive Personal Information through the App. If you choose to use one of the paid versions of the App, we will direct you to a third-party payment processor to provide a credit card number and other personal data needed to complete the transaction. Our payment processors will be certified to meet the industry standards for security and confidentiality, as well as applicable laws.

Use Data:

By choosing to use the App, you agree to provide Vybe with certain information that is automatically created, collected, and recorded by your use of the App (“Use Data”). Use Data may include your age range, whether you are a new or return user, your mobile device type, browser type, certain device settings, device network/carrier, approximate geographical location information, and current IP address.

Vybe uses third-party website browser software tools (the “Tools”), such as “cookies,” web server logs, and analysis software (including Google Analytics) to gather Use Data. The Tools may be used by Vybe to, among other things, collect business and technical statistics in order to improve, protect, and promote the App. For example, cookies, which are small pieces of data that are stored on your hard drive, help us with things like remembering your username for your next visit, and understanding how you are interacting with the App. You can disable the cookies in the App, but this may limit your ability to use the App.

How do we use your information?

Vybe uses your information, including Personal Information, for various purposes in connection with its business, including, but not limited to, providing and managing services in connection with the App, providing customer service and support, responding to your inquiries and requests, providing you with information related to the App or that we otherwise believe will be of interest to you, and notifying you about certain changes to the App.

Vybe uses Use Data in order to monitor use of the App and our services, for the App’s technical administration, and to improve the App and our services. We also use Use Data for marketing purposes, to conduct tracking and analytics, and to help us understand how people use the App.

If you are using the App, we may send you emails to inform you about who is using your website. Each email we send contains an easy, automated way for you to unsubscribe from further emails from us. Select the "unsubscribe" link in the footer of an email from us and follow the directions to communicate your preferences to us.

Service Providers: We engage certain trusted third parties to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relations, database storage and management, data analysis, payment processing, and legal, accounting, and/or marketing services. We may share your Personal Information or Use Data with these third parties, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring third parties to maintain the privacy and security of your data.

Other Third Parties: We also may share, disclose, or transfer your Personal Information or Use Data with third parties as follows: (a) to government agencies, advisors and other third parties, where necessary and appropriate, in order to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to (i) comply with the law requiring such disclosure, (ii) protect Vybe’s rights or property, (iii) prevent a crime or protect national security or (iv) protect the personal safety of the users or the public; (b) if we believe your actions violate our Terms of Service or other policies; or (c) in connection with a financing or a sale, acquisition or merger of our business or our business assets. Non-personally identifiable information may be provided to other parties for marketing, advertising, or other uses.

Third-party links

The App may contain links to external websites or applications. Please note that this Privacy Policy applies only to the App, and not to third party websites or applications to which the App links. Vybe is not responsible for the practices and policies (including privacy policies) of third parties and, therefore, you should review the privacy practices and policies of such third parties prior to providing your Personal Information in connection with such websites or applications.

How do we protect your information?

Vybe uses reasonable care to protect the privacy and security of Personal Information and to ensure that our systems are secure and meet industry standards. Where appropriate, we employ firewalls, encryption technology, and user authentication systems (e.g., usernames and passwords) to control access to systems and data. Unfortunately, no Internet transmission is ever completely secure, and we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORIZED USE OF YOUR PERSONAL INFORMATION OR OTHER DATA.

Unauthorized Use

Unauthorized attempts to use the App in a way that violates our Terms of Service, to utilize the App for other than its intended purposes, or to defeat or circumvent the App’s security features are strictly prohibited. We do not intend for the App to be used by children under the age of 13, nor do we seek to collect information about children under the age of 13. If you are under the age of 13, please do not provide us with any information and promptly exit the App.

Privacy Policy Updates

Vybe may amend, update or modify the terms of this Privacy Policy at any time, by posting an amended Privacy Policy on the App. If you do not consent to the terms of this Privacy Policy, as amended, you should not access or use the App in any way and should immediately remove the App from your mobile device. By continuing to access or use the App after those changes become effective, you agree to be bound by the revised Privacy Policy.
